The issue of the permanence of the Sharia is a matter that faces many questions and is not, like the principle of finality, which can be easily accepted rationally. The first question that arises is the issue of the evolution and essential movement of human history: how can a single version be written for a changing human being? What can justify the permanence of the Sharia despite the evolution, the movement of the essence of history, and the changing conditions in time and space is the institution of “ijtihad.” Without the institution of ijtihad, the theory of the fixed Sharia will face a serious theological problem, while the Sharia, accompanied by ijtihad, can respond to human demands in the context of history in step with social developments.
